DEFINITIONS
Any reference to a statute means the legislation bearing that name at the time the Agreement is signed and includes its regulations and any amending or successor legislation. For example, “Family Law Act” means the Family Law Act, R.S.O. 1990, c. F.3, as amended, and includes O.Reg. 391/97
“domestic contract” has the meaning given it by the Family Law Act, R.S.O. 1990, c. F.3;
“equalization of net family property” has the meaning given it by the Family Law Act, R.S.O. 1990, c. F.3;
“equalization payment” means the payment referred to in section 5(1) of the Family Law Act, R.S.O. 1990, c. F.3;
“net family property” has the meaning given it by the Family Law Act, R.S.O. 1990, c. F.3;
“property” has the meaning given it by the Family Law Act, R.S.O. 1990, c. F.3;
“spousal support” means spousal support pursuant to both the Family Law Act and the Divorce Act whether interim, limited term or permanent or whether periodic or by way of lump sum and whether payable to the other party or to third parties; and
“will” means:
i. a testament,
ii. a codicil, or
iii. an appointment by will or by writing in the nature of a will in exercise of a power, and any other testamentary disposition.
2. BACKGROUND
The parties married each other in Windsor, Ontario on August 17th, 1999.

b. They have three children (the “children”); namely Jacob Michael Boyd, born on October 21, 2001; Melissa Maria Boyd, born on March 13, 2005; and Tyler Marcus Boyd, born on July 11, 2008.
c. They have been living separate and apart since February 14th, 2014 and there is no reasonable prospect that they will resume cohabitation.
