Carriage contract

There are many definitions to the Carriage Contract; some define it as “the contract whereby the carrier is committed to the transfer of people or goods from one place to another by plane for a fee”

Others define it as “An agreement by which the carrier bins himself to carry objects or persons to a certain destination in consideration of certain fee.

A carriage contract is concluded upon mutual agreement unless both parties have expressly or implicitly agreed to delay it until the date of delivery.

Air transport contract

The air transport contract can be defined as “An agreement by which the carrier binds himself to carry an object of person to a certain destination for a fee by air”.

Characteristics of the air transport contract:

Air transport is characterized by a number of characteristics which are:

1. Consensual.

2. Commercial character.

3. Commitment of both sides.

4. Status of compliance.

5. Account profile.

1. Consensual:

Air transport is a consensual contract that is held as soon as the convergence of offer and acceptance without the need to empty it in a particular form.
