The most persuasive were the claims made by the union. The union had the valid points reguarding how the employees were being treated unfairly by Mr. Melton. It was a form of harassment on his behalf. It could have became a hostile environment if he would have stay in the position. It seems like he was having some controlling issues and trying to force employees to keep him inform. If he would have known who attended the meeting by the union, I feel he would have terminated the employees. On December 08, 1975 Orval Schimmel, a union organizer did contact the employers’ property manager Thomas Hall. Hall directed Schimmel to the vice president Carl Alton. Schimmel concerns was never addressed since hall dismissed any concerns he had regaurding the employees rights.
The employees were protected by the Railway Labor Act which allow employees the right to organize and bargain collectively with management. Also the union claims were more accurate since employees were being questioned about joining a union and asked who were part of this union. Mr. Melton contacted an employee George Thompson a few times questioning him about any union people contacting him. Mr. Melton violated Mr. Thompson rights by reminding him he got a nice job apartment Ivancevich (2010). I feel the employees felt threaten by Mr. Melton due to his hostile behavior. In my opinon , the union was spot on about this management treating the employees unfairly. I feel the union should have gotten invovled due to the management team being unprofessional. I feel laws and policies were broken at the supervisory level. I feel the management team should have been fired due to the union findings. I feel employees were black mailed by the management team.
Mr. Melton ignored the Railway Labor Act which prohibits yellow dog contracts in which employees promise not to join unions in exchange for employment Ivancevich (2010). Mr. Melton gave Mr. Thompson an ultimatum stating you either with me or against me Ivancevich (2010).
