STEP 3:

After deciding to name our company “PARCUM”, we have to figure out if this name is available for registering or not. The San Diego County Assessor/Recorder/County Clerk’s office is the official government agency that is responsible for fictitious business names. Bringing the availability of our name to light is easy: We have to visit the Website for searching for fictitious business names (https://arcc.sdcounty.ca.gov/Pages/Fictitious.aspx) and type in the name. Luckily, another company in San Diego County does not choose our name already so we can use it without any doubts. Attention: Fictitious Business Names are filed only in the county where the business is located. Statewide registries do NOT exist.

There are also the possibilities to search in person or via mail. To do it in person, we have to attend one of the office locations between the business hours from 8.00 am to 5.00 pm, Monday through Friday. To search by mail, we have to provide the exact business name and, if applicable, the owner name to be researched. This enclose $5.00 for each business or owner name to be researched and $2.00 for each copy of the statement requested plus $1.00 if certification is required. The easiest way to search is definitely via online.

We need a fictitious name because our business name does not include the surname of the individual owner, and each of the partners and the nature of the business is not clearly evident by the name. We are required to file a Fictitious Business Name Statement with the Recorder/County Clerk, within 40 days of first transacting business.

The San Diego County Assessor/Recorder/County Clerk’s office highly recommends to file in the Fictitious Business Name Statement by person because of its importance. To do that, we have to ensure the name we intend to file is not already registered. We have also to complete the filing form provided online legibly. Finally yet importantly, along with the payment and the completed form, we as the registrant will be required to present valid government issued photo identification to adequately determine identity at the customer counter of the San Diego County Assessor/Recorder/County Clerk’s office.
