Discuss why good emergency management preparation is important in avoiding liability problems and remaining compliant with state and federal regulations. Consider the duty of the organization during an emergency.
Good emergency management preparation is vital in coping with potential liabilities that usually arise during emergency response situations. An organization whether profit making or nonprofit making must worry about potential liabilities for their actions during an emergency. A firm is said to be liable when it is found to be legally responsible for its actions or their failure to act. Furthermore such firms are also expected to remain compliant with the state and federal regulations during emergency response situation. The following are some merits of good emergency management preparation.
- Creation of federal and state statutory protections against liability- this have been created to address the concerns of those in organization involved in emergency response and ensure there is adequate number of individuals and organizations to participate in response effort.
- Helps to protect against civil liability- this may include negligence, intentional torts, violations of statutory or regulatory requirement, constitutional violations and strict liability.
- Protection against direct and vicarious liability- This occurs where organizations can be held liable for their own actions as well as actions of other entities. Good emergency management preparation will help to avoid such liability.
- It helps in designating persons as independent contractors rather than as employees or agents in organizations- this makes these persons liable other than the organization itself.
- Helps to avoid charges made by a governmental entity of criminal, civil, and administrative wrongs- Good emergency management preparation helps in avoiding this by ensuring that organizations follow closely the stated regulations by the state.
In conclusion a good emergency management preparation is vital in every organization as it will help in immunity in some liabilities and also avoiding high charges as a result of non-compliance.
