Criminal Law Paper

I chose Abercrombie & Fitch Supreme Court case for my paper. This case is of a Muslim woman named Samantha Elauf, who was declined a position at the Abercrombie & Fitch store because she wore a head scarf that did not comply with the store’s company dress code. This case is very important because it shows how Abercrombie & Fitch deals with their policies that comply with people from a different religion or nationality.

In this case, Elauf was informed by a friend that in one Abercrombie & Fitch store they know of had a Jewish that wore a white yarmulke. She was also told that the store prohibited people to wear black, so she should not wear a black head scarf. She did not listen to the friend’s advice and went to the interview anyway wearing her headscarf. When she arrived at the interview, she was looked upon in a negative way because of her head scarf. She finished the interview and left. She later called Abercrombie & Fitch to see if she got the model position and she was told she did not get the job because of her head scarf. It was said that the scarf did not comply with the company policy.

I chose this case because it still amazes me how there are still stereotypes and racism in today’s society. It is very interesting how companies treat people a certain way because of their religion and the way they look or dress. We should be past judgment because we are in the year of 2015.

Criminal liability is needed to prove that a defendant is guilty of a crime. In order to prove that there is criminal liability, there needs to be proof that the person committed a criminal act and secondly, that they did so with intent. Accomplice liability usually allows the court to find a person criminally liable for acts liable for acts that are committed by different people. If a person helps any type of way that is assisting a criminal with a crime. In this particular case, there is really no type of accomplice to any crime that can be charged to any individual. This is simply a case that someone is suing a company for unfair treatment.
