Strict Liability

Strict liability is based on public policy instead of based on fault. There are three activities that give rise to strict liability are: 1. Manufacturing or distributing a defective. 2. Maintaining a dangerous animal. 3. Engaging in an abnormally dangerous activity. A defense to strict liability is assumption to the risk. This happens if the person knows that the certain product is dangerously defective, and decides to use it any way, there will be no liability. (hames,Ekern157-158
What is still the most confusing to me is the author's inner struggle to kill the animal. He talks about how much he doesn't want to do it, and then at the end of the story, he claims that he is happy with his decision. It seems like he is very strongly influenced by the people around him, and I'm still not sure whether or not he believes he made the right decision.

Jacob Simmons can be charged with a number of crimes. The first crime would be battery. Battery is a reckless or intentional, harmful, or offensive touching of another. When he hit the guy with the bar bottle it became battery. The second crime is Assault. Assault is placing another in apprehension or fear of an imminent battery. He told the guy that he better stay away or he will be sorry this could put fear in that person. (Hames, Ekern, 358) The last crime is attempted murder. Jacob hit the guy with a beer bottle that resulted in a cut.
