Criminal Justice System

In the interactive CJi learning module defines crime as “A conduct in violation of the criminal laws of any state, government (federal or local), or the jurisdiction which there is no legal defense or excuse.” There are many controversies when it comes to defining crime. It happens to be a very difficult to agree upon. Looking at it from a sociological view crime is a perception. This should include behaviors which are not defined by the law or the political process. Sociological also looks at crime as a disorderly act the needs to be blocked to uphold peace in society. Looking at crime from a psychological view proposes that crime is the individual’s way of showing the inability to follow rules in society.  Psychological does not have any concerns about the old basics of crime. If there is one person that cannot respond properly to the demands of the law, then the individual could be thinking criminal. The Christians define crime as wrong doing against God’s law. It does not matter if it is in the Bible, or the Koran they still look at crime as doing wrong towards God.  Crime can also be defined as unethical behaviors or actions that break the law.

The sociological theory, rational choice theory, and the psychological theory is how the criminal justice system classifies criminals. The sociological theory is the hypothesis of the contributing factors of criminal behavior. This comes from not being able to discipline self. The rational choice theory is the theory that crime was committed by a person. People commit the crime because they believe that a benefit of doing so is worth their freedom and want to gain power and to get money. In the psychological theory the hypothesis is that the crime effects psychopathic and personality. It has disorders that could develop from physical and sexual abuse.  These theories will help to better understand why so many different types of crimes happen and try to prevent crime from happening.

The most common models of how society regulates which acts are criminals are crime control and due process. The crime control model is important to the prosecuting enforcement when the individual commits criminal act.  The due process model focuses on a person’s freedom. This will avoid putting the weight on the enforcement and prosecution. The crime control model put on a heavy promise on the officers’ abilities and skills their administrative investigation process. This helps to bring forward and recreate what happened in an alleged criminal act. The due process model encounters it by doubting the facts that are found during the process. This is done by focusing on the officers’ integrity of people wrongdoing during his investigation of what happened.
