Jake & Maria Johnston are expecting twins. Maria has been with her employer for 2 years and Jake has been with his employer for 5 years.

They would like to take the maximum allotted time available to be with their new children. They need your help to understand what they are entitled to, the limitations set by the ESA and the compensation provided by EI.

Identify what types of leave Maria is entitled to and the qualifying conditions of such leave.

Maria is entitled to pregnancy and parental leave. The pregnant employee who can be entitled to pregnency leave first have to work for an employer that is covered by the ESA ans also have to be hired at least 13 weeks before the date her baby is expected to be born. The new parent who can be entitled to parental leave have to work for an employer that is covered by ESA and also have to be employed for at least 13 weeks before commercing the parental leave.

Identify what options are available to Jake. Further, outline how much time in total both Maria & Jake can take between them and how much time off is compensated in total.

Jake can decide totake a parental leave or not. Maria can have a maximum of 17 weeks of pregnancy leave and then take a parental leave up to 35 weeks. Jake can be entitled to take up to 37 weeks of parental leave. Therefore, there are 35 weeks leave for Maria and Jake can take togethor. The total time they can take is 89 weeks. Employers do not have to pay wages to the emplyees who is on parental or parental leave, therefore there is no compensation in total.
