Role and Functions of Law
In this paper I will discuss the role and functions of the law. I will also discuss how law applies to society and business, and the role law plays in my industry and current job. According to the textbook, Law is defined as, “A body of rules of action or conduct prescribed by controlling authority, and having legal binding force” (Melvin, 2011). The common characteristics of law are that it creates duties, obligations and rights for a given society. Personally I define “Law”, as a set of rules created by the government to govern the world.
The functions are law is very complex. Laws are put into place to facilitate our freedom. Laws are classified by categories and subject matters. These include constitutions, statutes, common law, administrative regulations and decisions, treaties, ordinances, and executive orders” (Bushman, 2007). Although laws seem to some to not promote freedom but without laws society would not be able to function effectively. Imagine how unfair the world we live in would be without a legal system.
Law plays a significant role in business and society. Law regulates ethical standards and set expectations of a business and in society law regulates social behavior. Businesses have an obligation by law to treat each person fairly and not be discriminatory. As a member of society there are laws in place that we must abide by so that the rest of society have peace, at least that is the purpose.
In this case cited in our book, Cipollone v. Liggett Group, Inc., et al., Cipollone filed a lawsuit against the cigarette manufacturing company, Liggett Group. Cipollone alleged Liggett Group was responsible for his mother’s death because of, “false advertising, fraudulently misrepresenting the hazards of smoking, and conspiracy to deprive the public of medical and scientific information about smoking” (Melvin, 2011).
