Roles and Functions of Law in Business and Society
Introduction
Ever since the creation of man there has been some type of governance that has evolved over the centuries. In this paper the roles and functions of the law that relates to business and society will society and our businesses as we know it today and without these laws we would be a very different society. More recently these laws have not been used properly at all times. In this era there are issues with honesty and integrity within our society. But the basis of law is rules, regulations, and procedures in which these are used to keep honesty and integrity alive not only in business but society too. Law has primary roles in business and society today and with its ethical conduct in business. “Modern law in the United States regulating businesses and individuals is generally a combination of constitutional law, statutory law, common law, and administrative (regulatory) law at the federal, state, and local levels” (Melvin, 2011, p. 8). These primary sources of law can also work in combinations with laws for federal and state levels. It created the three separate branches of government and gave each branch specific rights and duties to follow. But requires them to follow specific rules and processes so that wrongful laws cannot get passed ultimately protecting the citizens. These laws are the most permanent of all laws in America (Melvin, p. 8, 2011).
Statutory, Administrative, and Common Laws
According to Melvin (2011), Statutory laws were made by a legislative branch elected representative, and either decided upon by the executive branch (p. 9). The United States Congress passes all federal laws and can only be over ridded by the president of the United States but if the Congress can get two thirds of the vote than the president’s decision can be overturned (Melvin, p. 9, 2011).
Administrative law, “is largely authorized by statutes and the Constitution, and rules for applying the law are articulated and carried out by administrative agencies” (Melvin, p. 10). Administrative laws to set what is
