Addressing International Legal and Ethical Issues Simulation
A major issue in resolving legal disputes in international business is the conflict of laws guiding international business by countries involved. The process of resolving these disputes may prove difficult as both countries may have different legal codes and may not subscribe to common conventions guiding international trade (Mellvin, 2010).
In taking legal action against a foreign business partner, a major consideration that must be decided upon is which country's law will be applicable especially when both countries have different provisions in their laws guiding international business. Other considerations would be the forums through which legal disputes can be resolved as well as the hiring of those that have extensive knowledge of the laws and conventions that may impact the legal actions between an organization and a foreign business partner (University of Pheonix, 2014).
Certain factors could adversely affect CadMex's interest. The political climate at Candore is unstable and being under a dictatorship, could see some level of government interference in setting aside the agreement or prevent its renewal in the future. Another factor is that the transfer of technology and personnel could provide Gentura the capabilities of producing cheaper generic products which may expose CadMex to financial losses if the government of Candore decides to promote Gentura's product by setting aside the existing contract (University of Pheonix, 2014).
