Memorandum

Ms. Singh.

First, allow me to thank you for choosing our firm to represent you. Secondly, calm down things are not as bad as you perceive them to be. Let me explain to you what misdemeanors and felonies are and then I will explain what your charge is. Upon completion you will have a better understanding of your situation.

A misdemeanor is an offense that is more serious than an infraction i.e. a speeding ticket but less serious than a felony. Various jurisdictions have three levels of misdemeanor carrying different punishments. The most jail time that a person charged with a misdemeanor can serve is 364 days also fines can be levied.

Felonies are the most serious of crimes. Rape, murder, arson, and burglary are some examples of felonies. Felonies also have various levels, but with felonies there are varying degrees usually 1st, 2nd, and 3rd as well as repeat offenders and first offender. The reason for separation is so the repeat offender’s punishment is more severe than first timer who may learn from the experience and never return. As with a misdemeanor, fines can be levied the difference as in the crime the punishment is exponentially higher. Jail terms start at one year and can go up to a life term depending on the seriousness of the crime. In some states certain crimes are punishable by capitol punishment (death).

Now for the good news, you have been charged with a breach of the peace. A breach of the peace is commonly known as disturbing the peace. While this is a crime it is a relatively minor crime and as such you could receive a fine or jail time. As this is your first offense the odds are you may receive a fine and probation. I hope this has answered your questions and calmed your fears. Have a nice day.
