DADE COUNTY EEOC COMPLAINT

In April of last year Ms. Delores Mendoza filed a race and sex discrimination complaint against Dade County to the U.S. Equal Employment Opportunity Commission (EEOO). Ms. Mendoza argued that because she is a woman and part of a minority (Hispanic), she was not promoted to the supervisor of Accounts receivables position. Later, in September of the same year Ms. Mendoza filed a second complaint. This time she argued that she had been a victim of a retaliation action by her supervisor Mr. David Flood.

LEGAL AND ETHICAL ISSUES

1. Whether or not Ms. Mendoza has been a victim of sex and race discrimination at work.

2. Whether or not Mr. Flood, her supervisor incurred in a retaliation action against Ms Mendoza when he evaluated Ms. Mendoza’s work performance.

3. Whether or not Mr. Flood’s decision in not promoting Ms. Mendoza to the supervisor position was completely biased and based on prejudice and stereotyping

Facts

1. For the last 12 years Ms. Mendoza has been promoted five times.

2. During the last two years Ms. Mendoza undertook many of the responsibilities of the supervisor of accounts receivable position.

3. For twelve years her performance appraisal were rated EXCELLENT and they showed no lack of productivity.

4. During her twelve years as an employee in Dade County, two white males had been promoted around her.

5. David Flood, the director of the treasury Department of Dade County, transferred and promoted Tom Adams - supervisor of Account payables and an employee of Dade County for just 2 and half years- to supervisor of account receivables.

6. Ms. Mendoza was selected by her peers to serve as their representative on the annual Department Christmas party committee.

7. Spokesperson for the Hispanic coworkers.

8. Treasurer for the Miami Lakes Hispanic American Association.

1. The comment done by Mr. Flood and heard by one of Ms. Mendoza’s close friend.
