Introduction
Probation can be determine by a Judge to minimize serving time in prison. Is a great tool to minimize cost on the jail system, and to ensure that criminals are accounted for their actions. In this paper I will cover the basic principles, and attribute that a defendant must possess to qualify for probation. Probation is an important factor of the criminal justice system and give judges the option to keep people track by probation officers instead of crowding the prisons. Is important for us to understand the procedures to place a person in probation and the impact to society.
Consideration of Probation
In my opinion Kris has a problem of behavior and his environment are influencing him to continue with his conduct. I will agree with Robert in many instances, but of all I will say that Kris need peer support. I do agree with Robert in the following instances:
1- Crime history, marital status, education, and employment can help to predict a successful completion of probation. I would say that is real important to get a background of the problem. In this case we know that Kris has a criminal record from an early age, and continued through his life making some mistakes. In the other hand we must establish his relationship with his parents, as well as his graduation from high school. He also stated that he wants to go to college and start a business. It seems that Kris wants to prosper, but he made some bad decisions on the way. What made Kris to make those decisions? It seems that he had all the tools to be successful, but somehow he failed. In my opinion I can defer with Robert, in the way that education can help, but can also be a tool of advantage for a criminal. Education can be taken in to consideration for probation, but it should be taken seriously. Criminals are becoming smarter in the ways they perform crimes, and law enforcement must ensure that they can keep up with criminals. Many criminals are way ahead in technology as well as inform on how to use the new technology.
2- Biweekly monitoring to report to the probation officer. I agree with Robert, but I would prefer weekly, this way I can keep Kris staying out of trouble. Reporting to the probation officer is critical for Kris, and for Robert. The combination of cooperation from Kris and the help of Robert can make positive changes, and help the rehabilitation of Kris. In my opinion I would say that to help somebody like Kris we must engage the problem in an active way, meaning that counseling must be provided, and progress should be recorded.
