Role and Functions of Law
There has always been the rule that would build society through history today our laws are designed to fit our constitution. Laws are meant to govern how people are to conduct themselves in society how individuals interact with one another and how they interact with business and how businesses interact with individuals and society. The Government regulates the way business is conducted in the United States through various government agencies like the EPA.
Role and Function
The Role and Function of law in society is to regulate the behavior of all individuals in our society. The United States has a federal national system that cooperates with all the different state governments (Melvin, 2015). Our Constitution explains this system by listing the limits of the power the federal government has that regulates businesses and people. Local authorities are better equipped to understand local needs of the people. Following rules regulating behavior help to ensure safety and fairness in society. Laws have different functions the law helps resolve disputes between individuals through litigation. Litigation has multiple parts to it which are: Pre-lawsuit, Pleadings, Motions, Discovery, Pre-Trial, Trial stages (Melvin, 2015).
Regulations and Enforcement of Contracts
Contracts are an essential part of doing business within society and out texts defines a contract as “A promise or set of promises enforced by law” (Melvin 2015). There are different kinds of contracts enforced and upheld by private laws in the United States from written contracts to oral contracts, express contracts implied contracts. Businesses create these contracts every day for employment or to subcontract work lease property. The law tries to ensure both sides of a contract are represented and treated fairly (Paraschive, 2011) . My place of employment, a manufacturing facility the owner entered into a contract with another company to manufacture and ship products to distributors.
Criminal and Civil law
Criminal laws are laws the people are subject to that regulate behavior for example DUI's Driving under the influence of alcohol or drugs. Civil law is the law by which individuals can bring lawsuits against one another for wrong doings. Criminal law would deal with someone assaulting someone civil law would deal with a lawsuit filed by an assault victim for medical costs and other damages.
Procedural and Substantive Law
Substantive laws are duties and the rights of people, substantive law says that killing someone is a crime. Procedural laws are procedures that regulate court proceedings, how a trial takes place and how sentencing is done.
