Subject: Course of action with regard to the viral wedding video featuring Mr Brown’s Song

I have closely examined the case and have explored different alternatives which you may exercise in the current scenario. After reading the case facts I have analyzed the options perspective of legal standards, financial implications, the contractual obligations of Sony towards the artist and the effect that the decision may have on the image the artist and/or Sony and three possible options seem to be available to handle the situation. The options are—to issue a legal notice and take the video down from Youtube, alternatively, you can also issue a copyright notice to the host and negotiate a deal to put “click-to-buy” overlays on the video. The third option is that Sony and the Jive group does nothing and maintain silence on the issue. I believe that the best option would be to negotiate a deal with the hosts and put “Click to buy” overlays on the video. This would allow Jibe group to capitalize on the viral nature of the video to boost the sales of the Song, which would be beneficial to both the group as well as the artist. The report is enclosed herewith for your perusal.

Executive Summary

A video made during an unusual wedding in St. Paul, Minnesota, has gone viral and has registered close to 33 million views worldwide. The bone of contention is that the video features a song “Forever” written by Mr Chris Brown which plays in the background. The copyrights to the song are retained by Jive Group, which is mulling the various options it can exercise to deal with this situation. The groups primary objective is to maximize the benefit from the song to the artist while making sure that the public image of the artist, who is currently in jail in connection with a domestic violence case is not hampered further.

Jeff Dodes, the executive vice president, has three available options. First is to issue a take-down notice and ask the host (Youtube) to remove the content from the internet, the second would be to do nothing and let the video garner the attention, with the hope that this might lead to an increase in indirect benefits to the artist. The third option is to negotiate a deal with the host and place “Click-to-buy” overlays on the video.

The third option is recommended as it would provide Jive group to maximize the success of the video and at the same time ensuring that the artist’s public image, is not impacted by any further controversies.
