There Are Three Main Classifications of the Roles of the Law

Laws are rules and regulations that make sure common sense is followed. Laws have several roles and functions in business and society. Laws can be called an ethics enforcer. According to our textbook, the term law has been defined as a body of rules of action or conduct prescribed by controlling authority, and having legal binding force. Some characteristics of law is that it creates duties, obligations, and rights that mirrors accepted views of society.

There are three main classifications of the roles of the law. One of the roles is the substantive and procedural law. Substantive laws are the rights and the roles of people, and procedural law are guidelines in which the government bodies have concerns with the breaches in substantive laws. Substantive law basically deals with the substances of any charges. This law requires that the prosecutor proves every element of the crime, to prove that someone is guilty of a crime. Procedural law basically sets out the procedure of how the case will go. The procedures are based on which state the case is in. Each state has its own procedures ("What Is The Difference Between Procedural And Substantive Law", 2014). The second role is criminal and civil law. With criminal law, the litigation is made by the prosecution and with civil law a private party files a lawsuit and then they are the plaintiff. Criminal law punishments include incarceration, fines, and execution. In civil law, a defendant is not put in jail or prison, neither or they executed. Normally whatever the defendant owes, the amount is reimbursed to the plaintiff (Standler, 1998).The third role is public and private law. Public law is when the relationship between the government and the individuals are defined. Private law is when a group and an individual interacts with each other. Areas that are covered under a public law includes: administrative, criminal law, and constitutional law. Private law includes properties and contracts ("Difference Between Public And Private Law", 2014).When it comes to business and society, these three groups of laws defines what is and is not a crime, while also providing protection for both.
