PARI VS. PIRACY

INTRODUCTION:

The Philippine Association of the Record Industry has a noble if not enormous undertaking of managing the entire Philippine music industry, from the pricing of its software media to determining royalties to coordination with international record industry associations.

The sales of music software had decline at an alarming rate due primarily to the proliferation of music piracy. The company was headed by Danilo Olivares, president of PARI.

Problem Identification:

It was the birth of CD format that boost sales in music industry but it was also the culprit on its downfall. Many home computers are capable of burning music into CD by writers on their computers. This led to the explosion in the manufacturing of pirated CDs.

SWOT ANALYSIS:

Strength

  • Brought pride to the Philippines as our talented singers and composers won recognition and reaped awards in concerts.
  • Contributed to the economy by providing thousands of jobs.
  •  Provided financial support to government by way of paying millions of pesos in various taxes.
  • Discovered and provided opportunities in the field of music to our many talented singers, musicians, and composers.

Weakness

  • Rampant CD piracy.
  • Like drugs, piracy is big business with little capital. Thus the entry of big time well organized international syndicates.
  • Big demand as consumers are attracted to the cheap bargain of pirate CDs and VCDs.
  • Lack of government act to stop piracy.
  •  Law men are hesitant to confiscate pirate CDs by themselves, because of their lack of expertise in knowing what is fake and what is not.

Opportunities

  • New laws must be enacted to increase penalties and put more teeth to enforcement.
  • House Bill 11855 was proposed. This act sought to curtail entertainment media piracy in Ph.
  • Penalization of mall owners if their tenants sells fake CDs.

Threats

  • Advancement in technology that can download music and the use of USB devices.
  • Availability of software that can play music in cellphones and small media devices
  • Internet and social media upsurge in followers and users.
  • Easy transfer of music using wireless connections like Bluetooth, Wifi.
  • Large storage devices like HDisk, USB than CDs.

Recommendations:

  • Government, with its resources and law enforcement capabilities, must step in to forestall the further deterioration of the industry.
  • Special prosecutors and judges must be well versed in the copyright law.
  • Cases filed must be expeditiously tried within a short period of time.
  • All government agencies tasked to protect IP must have well-coordinated action plan.
