In this great country called America, we have laws and regulations. For example, we have the constitution and bill of rights. This piece of legislature is the foundation of our country; it is part of what makes America great. For example, where there is a dispute of any kind might it be malpractice or negligence we can look to the law to help guide the decision making process. The law protects both the victim and the plaintiff. When it comes to cases that involve negligence of some sort, it is imperative that the law be examine very closely in order to bring about justice to the right party. For example, there is an article that one read about a country music band named “Sugarland” that was about to perform in a concert in Indianapolis with thousands of people in attendance when the stage collapsed and caused the death of seven people with many others severely injured, due to an act of nature. The question that one must ponder about is who is at fault? To find the answer one is going to give his opinion on the following question.
Summarize the relevant facts and include an identification of the party that would be a plaintiff and the defendant in a lawsuit.
The lawyer for the band named “Sugarland" issued a statement and said this. “The incident at issue in this litigation resulted from a gust of wind of unprecedented intensity, which caused a structure that may have been improperly designed, maintained, and/or inspected to fail. As such, this was a true accident or Act of God," One can see for this statement that the lawyer thinks that mother nature was at fault and that no one is responsible, because the incident was an act of God. If the statement stands than everybody win, the families of the victims would just pray that the victims find mercy and grace from God. The plaintiff would just rest easy with a good conscious by ignoring the fact that these people died.
The fact is, there are many aspects and ways to look at this incident. The first is that the people that were attending the concert did so for their own pleasure and nobody forced them to buy a ticket to attend the concert. The band “Sugarland” by inviting these people to attend assumed the risk and responsibility to protect the attendees’ safety. All the victims in this incident are the plaintiffs along their family
