Introduction and Facebook Terms of Service
The lecture on Contracts and the initial introduction to Business Law was quite enlightening for considering the fact that I have always has this fascination about legal issues. I quickly attribute the law with Police and other security operatives and the… big COURT. I have often wondered what of the law.at the law was all about and the tenets of the law. Law and Order was another fascination for me.
So looking at issues from the factual perspective and the legal perspective was something that really got me rearranging my thoughts. I have always examined issues based on facts …not considering the difference between evidence and facts. Getting around to define every position before we get to a conclusion on a matter really pulled me back to the nature of the legal system.
On the issue of contracts, looking through Facebook terms of service, the statements of Rights and Responsibility which is more of an open door to the offer of the contract is rather very ‘wide’ in terms of language and its translation consideration the global appeal that the service has. It is clearly stated there under the privacy article that they collect and use your information even with a third party. The offer limits from the viewpoint of the user is not clearly stated. On the issue of sharing and control of your content as a user, it is stated that the user has control as to what is being offered to the public but the fact is that the network has total access to all your information including what you have deleted or restricted.
The issue of a contract that is legally enforceable the basic conditions of basic element of consideration is corporately compromised here. According to its Statements of Rights and Considerations, when you even decide to leave the network, not all your information leaves because if the files that you have shared are further shared by others on the network, the remain visible to the public even after you have left the network.
Also when you signed the acceptance, you give Facebook the permission to sell your information under the statements of Rights and Responsibilities without any form of compensation to the user. Also Facebook can track the websites you visit. In essence Facebook can use you and your data for research and can at any time grant access to government agencies regarding its users. This development points us to the fact that the meaning of privacy is changing
