In this paper there will be a discussion that will identify the problems presented and the various relationships that are established by organized crime. We will also describe the legal limitations associated with combating organized crime. This will include a critique of major Federal laws and strategies that support this effort of battling organized crime. We will discuss a realistic solution to the problem of controlling organized crime by discussing and evaluating the effectiveness of organized crime prosecutions.
There are many issues that exist dealing with organized crime. As organized crime usually does not act in political gains, they do use political gains to achieve monetary goals. These issues stem from social control and moral regulation and reach even more into the political avenue. This includes establishing legislatures, organized crime groups creating the illegal markets they do, and the declarations of how big of a threat that can be.
As we have seen time and time again; not with just organized crime but with celebrities or other individuals or situations that the media or the government can establish the thought of being of anything they want. If they want you to look like a good guy they will, if they want you to look like a threat they will and can. So as it relates to organized crime they can be made to look like petty criminals, outlaw bikers, or major violent threats and have been. As in anything though organized crime is a business and just as any business that present goods, if there is customers and demand there will be the individuals to make a profit off of the demand. This creates a fascination of organized crime. Just the words alone “ organized crime “ can set off public support for legislature, win votes for an individual or a law, and attracts the media which is a big weapon for support for or against depending on how the media is used. This all has helped turn organized crime into a business or even an industry.
As it relates to organized crime legal limitations can vary. Legal limitations can make it difficult to prosecute organized crime groups or individuals. The defense can find and use loopholes in certain laws to help defend these individuals. A lot has to do with that every state legislature is different. Some laws may be similar and some are way different. This makes it difficult to prosecute using certain laws. This causes awareness by organized crime groups and what their limitations are within certain jurisdictions. We see more and more limitations put on law enforcement agency’s which opens it up for organized crime to take full advantage of basic individual rights.
