The Rio Sella Police department did not have an effective way of dealing with the gang. Gangs are obviously not a new phenomenon, but they are still a problem that has to be addressed. Criminal street gangs have become one of the most serious crime problems in California. Gang violence--particularly assaults, drive-by shootings, homicides, and brutal home-invasion robberies--accounts for one of the largest, single, personal threats to public safety in this state. The approach to gangs in the past was a reactive approach. Police would wait for a crime to be committed and then attempt to apprehend the suspect. This will only get you one or two gang members at a time. Gangs recruit and replenish their ranks. The loss of a few members is not really felt.

The idea of the temporary restraining order is that it will cut down on places the gang can gather. If you push them out of public places and private property, you force them to meet in a central location. If they violate the restraining order the police have the ability to arrest the gang members.

  1. Will the temporary restraining order really stop the gang, or will the gang simply move its operation to another location or town. Describe the disadvantages of using a temporary restraining order.

Yes the approach will work. There has to be a multi-jurisdictional effort. If the gangs are allowed to just move from one area to the next the issue will not resolve. Each district will need to work together. In Redondo Beach has won a temporary restraining order against the North Side Redondo 13 Gang that prohibits gang members from congregating in gang-ridden Perry Park and from associating with anyone carrying a firearm.

Protected Rights

Civil remedies must be framed in a way that does not infringe on a fundamental right of the gang members. The gangs still have the right to free speech and right to peaceful assembly. To per cure a conviction using temporary restraining orders the police must make sure they do not violate the rights of the people.  

Non-offending Parties

Not all people that “hang out” are going to be gang members. If everyone that is hanging out is picked up for violation of the restraining order teens that are not gang affiliated are bound to be arrested.
